Moment - Terms of use

These Terms govern your access to and use of the Moment app and related services (collectively, the “Service”) provided by Of the Coven Ltd (“we,” “us,” “our”).
By downloading, registering with, or using the Service, you agree to be bound by these Terms.
1. Who Can Use Moment
You must be at least 16 years old to use Moment in the UK.
You must have the legal capacity to enter into this agreement.
You must not use the Service for any unlawful or prohibited purpose.
2. Your Account
To access features, you must register and create an account. You agree to:
Provide accurate and complete information
Keep your password secure
Notify us immediately if you suspect unauthorised use
We reserve the right to suspend or terminate accounts that violate these Terms.
3. Health and Wellness Disclaimer
Moment is designed to help users spot patterns in their mood, practice DBT skills and track health and wellbeing information. However:
It does not provide medical advice, diagnosis, or treatment
It is not intended to replace consultation with qualified healthcare professionals
Predictions and insights are informational only and may not be accurate
Use of the app is at your own risk.
4. User Conduct
You agree not to:
Misuse the Service or interfere with its operation
Upload harmful, offensive, or misleading content
Attempt to gain unauthorised access to systems or data
We may suspend or terminate your access if you breach these Terms.
5. Intellectual Property
All content, software, trademarks, and data in the Service belong to Of the Coven Ltd or our licensors. You are granted a limited, non-exclusive, revocable, non-transferable licence to use the Service for personal, non-commercial purposes only.
You must not:
Copy, modify, or reverse-engineer the app
Distribute or publicly display content without permission
Use our trademarks without prior written consent
6. Privacy and Data Protection
Your privacy matters to us. We collect and process personal data as described in our Privacy Policy, in accordance with the UK GDPR and applicable laws.
By using the Service, you consent to the collection and use of your data as outlined in the Privacy Policy.
7. App Availability and Updates
We aim to provide continuous access, but we cannot guarantee uninterrupted or error-free operation.
We may update the app from time to time to fix bugs, improve performance, or add new features. Some updates may be automatic, while others may require your action.
You are responsible for keeping your app and device software up to date. We are not obligated to maintain specific features or compatibility with older devices.
8. Fees and Subscriptions
Some features may require a paid subscription. Payment will be processed through Stripe, and their terms apply.
Subscriptions may automatically renew unless cancelled at least 24 hours before the end of the billing period.
You can manage or cancel your subscription in your Profile settings.
All payments are final. We do not offer refunds for unused portions of subscriptions, except where required by law.
9. Third-Party Services and Content
Moment may contain links to third-party websites, apps, or content for your convenience. We don’t control or endorse these third parties and are not responsible for their content, privacy practices, or services.
You access any third-party content at your own risk, and their terms and privacy policies apply.
10. Indemnification
You agree to indemnify and hold harmless Of the Coven Ltd, its team, and affiliates from any claims, damages, or liabilities arising from:
Your use or misuse of the app
Your breach of these Terms
Any content or data you submit through the Service
11. Force Majeure
We’re not liable for any delay or failure to perform due to events beyond our control, including natural disasters, internet outages, strikes, government action, or cyberattacks.
12. Termination
You may stop using the app at any time. We reserve the right to suspend or terminate your account if:

You misuse the Service
We are required to do so by law
Upon termination, your licence to use the app ends, and your data will be handled in accordance with our Privacy Policy.
13. Limitation of Liability
To the extent permitted by law, we are not liable for:
Indirect, incidental, or consequential damages
Loss of data, revenue, or profits
Health decisions made based on app data
Our total liability will not exceed the amount you paid for the Service in the previous 12 months (if any).
14. Assignment
We may transfer our rights and obligations under these Terms to another company (for example, in the event of a merger or acquisition). You may not transfer your rights without our written permission.
15. Governing Law and Dispute Resolution
The laws of England and Wales govern these Terms. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
16. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you via the app or email. Continued use of the Service after changes means you accept the updated Terms.

18. International Use and Export Compliance
Moment is designed for users in the UK. If you choose to access the app from outside the UK, you are responsible for complying with local laws. You may not use the app in violation of export control laws.
19. Limitation on Claims
To the fullest extent permitted by law, any claim related to these Terms or the Service must be brought within one (1) year from the date the issue arises. After that, the claim is permanently barred.
20. Entire Agreement
These Terms and our Privacy Policy constitute the entire agreement between you and Of the Coven Ltd regarding your use of Moment, superseding any prior agreements.
